Tier 1 Investor visa UK provides an opportunity for individuals looking to invest at least £ 2 million in the UK market. This visa grants an initial stay of 3 years and 4 months for fresh applicants and the leave granted varies depending on previous leave granted or if the applicant is switching to this category of visa from another category.
The holder of Tier 1 Investor visa UK is expected to invest the abovementioned amount, within 3 months of entering the UK, in qualified investments (recognised as investments) and maintain the level of said investments for the period of leave granted under the Tier 1 category UK Investor visa.
The investments deemed to be qualified investments under this category of visas have gone through revision, the revised definition being effective on Tier 1 Investor visa applications made on or after 29th March 2019.
For ease of understanding, let us consider the qualifying investments before the most recent revision and after.
Investments considered as ‘qualifying investments’ for the Tier 1 Investor visa UK granted between the period 6 November 2018 and 28 March 2019 are as follow:
- Investments in UK government bonds
- Investment in the form of share capital or loan capital made within active and trading UK registered companies
*Any interest, dividends and profits received from the said investments are required to be reinvested into qualifying investments.
Investments considered as ‘qualifying investments’ for the Tier 1 Investor visa granted on or after 28 March 2019 are as follow:
• Investments in the form of share capital or loan capital in active and trading UK registered companies
Active and trading UK companies
Qualifying investments made by Tier 1 Investor visa holders in the form of a loan or share capital must be made within active companies and trading. A company considered as active and trading for this purpose (for applications made on or after 29th March 2019) is one which:
• Possess registration with Companies House in the UK;
• Is registered with HM Revenue and Customs for corporation tax and PAYE;
• Has maintained accounts and a UK bank account, both showing regular trading of its goods or services; and
• Has at least 2 UK based employees not being its directors.
A company considered as active and trading for beginning a business in the UK (for applications made before 29th March 2019) is one which:
• Equipped with a registered office or head office in the UK
• Holding a UK bank account showing current business transactions
• Is subject to UK taxation
*UK governments bonds will no longer be considered as ‘qualifying investments’ to prove investment under this category of visas.
Investments made in the UK market (by way of qualified investments) within the 12 months immediately preceding the Tier 1 Investor visa application shall be considered as an investment under this route, in support of the application.
