A Tier 2 Sponsor License holder must issue a Certificate of Sponsorship (CoS) to potential foreign individuals to whom jobs are offered in the UK. A foreign employee can apply for a Tier 2 General Visa, also known as entry clearance once they have a CoS issued by their UK employer.
There are two types of CoS and employers must always ensure that in every case the right and relevant type of CoS is issued to the applicant.
Selecting the correct Certificate of Sponsorship:
- Unrestricted Certificates of Sponsorship are allotted annually to the employers in their sponsor license account. These CoS are to be issued to new foreign employees with a salary of more than £159,600.An application for entry clearance under the Tier 2 Visa must be submitted within 3 months of the receipt of the CoS.
- Restricted Certificates of Sponsorship are usually issued to new employees applying from outside the UK to enter under a Tier 2 (General) visa and who will be earning under £159,600 per annum and this is also issued to family members (dependants) of Tier 4 migrants who are switching to a Tier 2 visa.
A restriction is placed on the number of workers that are to be admitted per annum to the UK under a Tier 2 Visa route with a restricted CoS.
There is no guarantee that a visa will be approved only on the issue of the CoS.
If a CoS is granted, the employer assigns the CoS to the individual, who can then use the reference number to apply to the Home Office for entry clearance application, once a CoS is allotted it cannot be transferred to any other person.
